Warranty & Returns Policy

This Warranty & Returns Policy applies to products purchased directly from www.nestful.com.au or from an official Nestful seller account where Nestful is identified as the seller of the product.

This policy applies in addition to, and does not exclude, restrict or modify, any rights or remedies you may have under the Australian Consumer Law.

For general information about consumer rights, you may refer to the ACCC’s guidance on consumer rights and guarantees, warranties, repair, replacement and refund rights, and online shopping rights.

1. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Consumer guarantees are automatic legal rights. They apply regardless of any voluntary warranty period offered by Nestful.

2. Nestful Voluntary Warranty

Nestful provides a voluntary 12-month warranty against defects for products purchased directly from www.nestful.com.au or from an official Nestful seller account where Nestful is identified as the seller.

The warranty period starts on the date of purchase shown on your Nestful order confirmation, tax invoice or other valid proof of purchase.

This voluntary warranty is provided in addition to your rights under the Australian Consumer Law. Your Australian Consumer Law rights may continue to apply after the 12-month warranty period, depending on the nature, price, quality, expected durability and use of the product.

This warranty information is available on our website and should also be read together with any product manual, product safety instructions, packaging insert, warranty card, order confirmation or other documentation supplied with the product.

Return warehouse address: The return address will be provided only after Nestful reviews the return request and issues written return instructions. Products must not be sent to any address until Nestful has issued a return authorisation or return instructions.

4. How to Make a Warranty, Fault or Return Claim

To make a warranty, fault or return claim, contact Nestful at:

support@nestful.com.au

Please include, where available:

  1. your order number;

  2. your full name and contact details;

  3. the product name;

  4. the batch number, serial number or product identifier, if shown on the product or packaging;

  5. a clear description of the issue;

  6. clear photos or video showing the alleged fault, damage or defect;

  7. clear photos or video of the product, packaging, shipping label and outer carton within 24 hours of delivery where reasonably possible, if the product arrived damaged in transit;

  8. any troubleshooting steps already attempted;

  9. proof of purchase; and

  10. any other information reasonably required by Nestful to assess the claim.

Nestful may request further information, photographs, video evidence, troubleshooting steps, inspection, or return of the product where reasonably required to assess the claim.

Nestful does not provide automatic refunds, replacements or credits merely because a customer requests one.

5. Return Authorisation Required

Before returning any product, you must contact Nestful and obtain written return instructions.

If your return is approved for assessment, Nestful may issue:

  1. a return authorisation number;

  2. a return shipping label, where applicable;

  3. the correct return address for that product;

  4. packaging instructions;

  5. instructions about which accessories and components must be included; and

  6. any other instructions required for assessment or processing.

The return address may vary depending on the product, supplier, warehouse, service centre, manufacturer or assessment process.

Items sent back without first requesting a return may be refused, delayed, returned to sender, or held pending further instructions, except where Nestful is legally required to accept the return.

Approval to send a product back for assessment does not automatically mean that a refund, replacement or warranty claim has been approved.

6. Return Shipping Labels

Where Nestful provides a return shipping label, the label must be used only for the approved product, approved order, approved return reason and approved return address.

Return labels must not be used for any other product, unrelated item, unauthorised return, change-of-mind return, or product not approved by Nestful.

Misuse of a return label may result in rejection of the return claim and may be treated as bad-faith conduct.

7. Product Assessment

Nestful is entitled to assess a product before providing a remedy.

Depending on the product and the issue, assessment may include:

  1. reviewing photos, videos and information supplied by you;

  2. reviewing order records, dispatch records, delivery records, product identifiers, batch numbers or serial numbers;

  3. asking you to complete reasonable troubleshooting steps;

  4. arranging return of the product for physical inspection;

  5. arranging assessment by the manufacturer, supplier or authorised service provider;

  6. checking whether the alleged issue can be replicated; and

  7. determining whether the issue is a manufacturing fault, transit damage, misuse, accidental damage, normal wear and tear, unauthorised modification, improper installation, improper maintenance, or another cause.

Nestful will assess warranty and return claims within a reasonable time, having regard to the type of product, the nature of the issue, availability of information, and whether manufacturer or supplier assessment is required.

8. Remedies for Faulty Products

If the product has a major failure under the Australian Consumer Law, you are entitled to choose a refund or replacement.

A major failure may include where the product:

  1. is unsafe;

  2. is significantly different from its description;

  3. has a serious problem that would have stopped a reasonable consumer from buying it if they had known about it;

  4. cannot be used for its normal purpose and cannot easily be fixed within a reasonable time; or

  5. cannot be used for a purpose you told us about before purchase and cannot easily be fixed within a reasonable time.

If the issue is not a major failure, Nestful may provide a remedy by repair, replacement, refund, spare part, troubleshooting support or another remedy required by law.

If Nestful confirms that the product is defective, Nestful will provide the remedy required by the Australian Consumer Law and this policy.

9. No Automatic Refunds

Nestful does not offer automatic refunds.

A refund, replacement, repair, spare part, credit or other remedy will only be provided where:

  1. required under the Australian Consumer Law;

  2. required under this voluntary warranty; or

  3. otherwise approved by Nestful in writing.

Nestful may refuse a refund, replacement, warranty claim or return where it is not required by law and where the issue is caused by customer conduct, misuse, accidental damage, unauthorised modification, improper use, or any excluded cause listed in this policy.

10. Products Damaged in Transit or Wrong Items

If your order arrives damaged, incomplete, or with the wrong item, contact Nestful as soon as possible at support@nestful.com.au.

For transit damage, missing item or wrong item claims, please notify Nestful within 24 hours of delivery where reasonably possible and provide clear photos or video of the product, packaging, shipping label, outer carton and any visible damage before discarding any packaging.

Prompt notice helps Nestful verify the issue with the carrier, supplier, warehouse or insurer and may be required for carrier or insurance assessment.

This 24-hour notification request does not limit your rights under the Australian Consumer Law.

Please retain the product, all packaging, shipping label, outer carton, accessories and inserts until Nestful confirms the next steps.

Nestful may reject a transit damage or wrong item claim if there is insufficient evidence to verify the issue, where the product has been discarded, where the packaging has been discarded before assessment, or where the available information indicates the issue was not caused before delivery.

11. Accessories, Packaging and Product Condition

When returning a product, please return the product with all accessories, chargers, cables, manuals, packaging inserts and components supplied with the original order, where reasonably available and relevant to the assessment.

You do not need to return the product in its original packaging to make a valid claim under the Australian Consumer Law. However, the product must be packed safely and securely to avoid damage during return shipping.

If items are missing, damaged, substituted or not returned, Nestful may take this into account where permitted by law and where relevant to the remedy, assessment or refund amount.

12. Return Shipping Costs

For products that can be posted or easily returned, you may be required to return the product so it can be assessed.

If Nestful confirms that the product has a fault, defect or other issue covered by the Australian Consumer Law or this voluntary warranty, Nestful will reimburse reasonable return shipping costs you have already paid, or provide a prepaid return label where appropriate.

If the product is large, bulky, unsafe to return by post, or otherwise unsuitable for standard return shipping, Nestful may provide alternative return, collection or inspection instructions.

If Nestful arranges return shipping, collection or inspection and the product is found not to have a fault, or the issue was caused by misuse, accidental damage, unauthorised modification, improper installation, improper maintenance, use outside product instructions, or another excluded cause, you may be responsible for reasonable collection, return shipping or inspection costs where permitted by law.

Nestful will provide a reasonable estimate of any such costs before charging them.

13. Warranty Exclusions

Subject always to your rights under the Australian Consumer Law, the Nestful voluntary warranty does not cover damage, fault, defect or loss caused by:

  1. normal wear and tear;

  2. misuse, neglect, abuse or physical damage;

  3. accidental damage after delivery;

  4. damage caused by dropping, impact, crushing, excessive force or mishandling;

  5. improper installation;

  6. incorrect operation or failure to follow the product manual, safety instructions or manufacturer’s instructions;

  7. incorrect or improper maintenance;

  8. failure to clean the product or improper cleaning;

  9. incorrect voltage, non-authorised electrical connections, power surges, power dips or electrical faults;

  10. exposure to excessive heat, moisture, dampness, corrosive conditions or unsuitable environments;

  11. fire, theft, vermin, insects, flood, storm, lightning, acts of God, terrorism or events outside Nestful’s reasonable control;

  12. use of non-authorised, non-standard, defective or incompatible parts, cables, chargers, accessories or components;

  13. repairs, modifications, servicing, opening, tampering or other work carried out by any person who is not authorised by Nestful or the manufacturer;

  14. cosmetic damage that does not affect product function, unless the cosmetic issue was present on arrival and notified to Nestful within a reasonable time;

  15. commercial, rental, hire, demonstration or high-duty use where the product is intended for normal household or domestic use, unless otherwise stated or required by law;

  16. use of the product outside its specifications, rating, intended purpose or published product instructions;

  17. customer-caused damage;

  18. damage caused by failure to use, store, charge or maintain the product as instructed; or

  19. any cause that is not a defect in materials, manufacture or workmanship.

14. Water Resistance and IP-Rated Products

Some Nestful products may have a published IP water and dust resistance rating. An IP rating does not mean the product is waterproof in all conditions.

Subject always to your rights under the Australian Consumer Law, the Nestful voluntary warranty does not cover water or liquid damage where the damage was caused by:

  1. failing to properly close, seal or secure the USB port cover, charging cover or protective cover;

  2. using the product outside its published IP rating;

  3. submerging the product beyond the depth, duration or conditions permitted by its published IP rating;

  4. exposing the product to salt water, chlorinated water, hot water, steam, high-pressure water, detergent, chemicals or corrosive liquids, unless expressly permitted in the product instructions;

  5. charging the product while wet;

  6. impact, cracking, seal damage or other physical damage that compromises water resistance;

  7. wear, damage or deterioration of seals, covers or ports caused by customer use, misuse or lack of maintenance; or

  8. any use inconsistent with the product manual or manufacturer’s instructions.

For products such as THE CLASSIC and M3 Table Lamp, water resistance applies only within the published IP rating and only where all covers, seals and ports are properly closed, maintained and used according to the product instructions.

15. Sales by Nestful, Third-Party Retailer Sales and Fulfilment Providers

This section explains the difference between products sold by Nestful, products sold by third-party retailers or resellers, and products dispatched by third-party fulfilment providers.

Products sold by Nestful

This policy applies to products purchased directly from www.nestful.com.au or from an official Nestful seller account on a third-party marketplace where Nestful is identified as the seller of the product.

Where Nestful is identified as the seller of the product, Nestful will handle warranty, return, refund and replacement claims in accordance with this policy and the Australian Consumer Law, even if the product is dispatched by a third-party warehouse, logistics provider, fulfilment provider, supplier or service centre on Nestful’s behalf.

A third-party warehouse, logistics provider or fulfilment provider is not responsible for assessing or approving consumer warranty, return, refund or replacement claims unless Nestful expressly directs you to deal with that party as part of the approved return or assessment process.

Products sold by third-party retailers or resellers

Where a product is purchased from a third-party retailer, reseller, marketplace seller or other business that is not Nestful, the customer should contact the seller from whom they purchased the product.

For example, if a third-party retailer purchases Nestful products as inventory and resells those products to the public under its own store, website, marketplace account, invoice, checkout or sales process, that third-party retailer is generally responsible for handling consumer guarantee remedies owed by that retailer under the Australian Consumer Law.

The customer’s first point of contact for a return, refund, replacement or remedy should be the third-party retailer that sold the product to them.

Business-to-business claims between Nestful and third-party sellers

If a third-party retailer, reseller or marketplace seller accepts a return, refund, replacement or remedy request from its customer, any reimbursement, credit, replacement stock, supplier warranty claim, defect claim or other recovery claim between that seller and Nestful will be dealt with separately between the seller and Nestful.

Those business-to-business matters are subject to any applicable wholesale, reseller, distribution, supplier, marketplace, trading terms or other agreement between the seller and Nestful.

A customer is not required to resolve, manage or wait for any separate supplier, manufacturer, distributor, marketplace, retailer or reseller reimbursement issue before exercising any valid rights they may have against the seller under the Australian Consumer Law.

Nothing in this section limits any rights a customer may have under the Australian Consumer Law against Nestful, the seller, a manufacturer, an importer or any other party.

16. Products Purchased from Third-Party Sellers

The Nestful voluntary warranty applies only to products purchased directly from www.nestful.com.au or from an official Nestful seller account where Nestful is identified as the seller.

This voluntary warranty does not apply to products purchased from auctions, marketplaces, unauthorised resellers, third-party sellers, private sellers or retailers where Nestful is not identified as the seller on the customer’s valid proof of purchase.

If you purchased the product from a third-party seller, retailer or marketplace seller that is not Nestful, you should contact that seller directly for return, refund, replacement and warranty assistance.

This does not limit any rights you may have under the Australian Consumer Law.

17. Change of Mind Returns

Nestful is not required to provide a refund, exchange or credit if you simply change your mind, find the product cheaper elsewhere, decide you do not like the product, order the wrong item, or no longer have a use for it.

Nestful may choose to accept a change-of-mind return at its discretion. If Nestful agrees to a change-of-mind return, the product must be returned in the condition specified by Nestful at the time of approval, which may require the product to be unused, unopened, sealed, complete and in resaleable condition.

Any approved change-of-mind return is subject to Nestful’s written return instructions.

Return shipping costs for change-of-mind returns are the customer’s responsibility unless Nestful agrees otherwise in writing.

Nestful may refuse a change-of-mind return where the product has been opened, used, assembled, damaged, altered, marked, contaminated, is missing accessories or packaging, or is not in resaleable condition.

18. No Fault Found, Misuse or Customer-Caused Damage

Nestful may reject a warranty, refund, replacement or return claim where, after reasonable assessment, Nestful determines that:

  1. the product is not faulty;

  2. the alleged issue cannot be replicated or verified;

  3. the product is operating normally;

  4. the product was damaged after delivery;

  5. the issue was caused by misuse, abuse, neglect, incorrect operation, accidental damage or customer conduct;

  6. the product was used outside the product manual, safety instructions, specifications, IP rating or intended purpose;

  7. the product was modified, opened, repaired, tampered with or altered by an unauthorised person;

  8. the product was damaged by incompatible accessories, incorrect voltage, non-approved chargers, non-standard parts or improper installation;

  9. the customer did not provide reasonable evidence required to assess the claim;

  10. the information supplied in support of the claim is incomplete, inconsistent, misleading or false;

  11. the product was not purchased directly from Nestful or from an official Nestful seller account where Nestful is identified as the seller;

  12. the product cannot be matched to a valid Nestful order, invoice, batch number, serial number or dispatch record; or

  13. another exclusion in this policy applies.

Where a claim is rejected after assessment, Nestful will explain the reason for the rejection.

Where permitted by law, Nestful may require the customer to pay reasonable return shipping, inspection, collection or redelivery costs if the claim is rejected and Nestful gave a reasonable estimate of those costs before they were incurred.

Nothing in this section excludes, restricts or modifies any rights the customer may have under the Australian Consumer Law.

19. False, Misleading or Bad-Faith Claims

Nestful takes false, misleading, abusive, fraudulent and bad-faith claims seriously.

Where Nestful reasonably believes that a customer has made a false, misleading, abusive, fraudulent or bad-faith claim, Nestful may, to the extent permitted by law:

  1. reject the refund, replacement, warranty or return claim;

  2. refuse discretionary benefits, goodwill refunds, promotional credits or change-of-mind returns;

  3. recover reasonable costs incurred because of the false or misleading claim, where legally recoverable;

  4. provide relevant evidence to payment providers, carriers, warehouses, insurers, legal advisers, dispute-resolution providers or relevant authorities where reasonably necessary to respond to disputes, chargebacks, investigations or recovery action;

  5. restrict or close the customer’s account for future purchases; and

  6. take any other action reasonably necessary to protect Nestful’s legal and commercial interests.

This section does not prevent a customer from exercising any valid rights they may have under the Australian Consumer Law for completed purchases.

20. Refunds

Where a refund is approved, Nestful will refund the amount required by law to the original payment method, unless Nestful and the customer agree otherwise.

Where required by the Australian Consumer Law, the refund may include the product price and applicable delivery charges.

Nestful will process approved refunds within 10 business days after the return has been received and assessed, or after Nestful otherwise approves the refund.

Your bank, card provider or payment provider may take additional time to process and post the refund.

If more than 15 business days have passed since Nestful approved your refund, contact support@nestful.com.au.

21. Replacements

Where a replacement is approved, Nestful will replace the product with the same product where available.

If the same product is unavailable, Nestful may offer an equivalent replacement, store credit or refund, depending on the circumstances and your rights under the Australian Consumer Law.

Replacement products are subject to availability.

22. Repairs and Troubleshooting

Where appropriate and permitted by law, Nestful may first provide troubleshooting support, replacement parts, repair instructions, repair assessment or authorised repair.

For minor failures, Nestful may choose the appropriate remedy, including repair, replacement or refund, as permitted by the Australian Consumer Law.

If a repair is not possible or cannot be completed within a reasonable time, Nestful will provide another remedy required by law.

23. Chargebacks and Payment Disputes

If you raise a payment dispute or chargeback with your bank, card provider, PayPal, Afterpay, Shop Pay or another payment provider, Nestful may provide order records, dispatch records, delivery records, claim correspondence, product evidence and return assessment information to the payment provider to respond to the dispute.

If a refund, replacement or return claim is already being assessed by Nestful, raising a chargeback may delay the assessment or resolution process.

This section does not limit any rights you may have under the Australian Consumer Law or with your payment provider.

24. Promotional, Clearance, Sale and Discounted Products

Promotional, clearance, sale and discounted products are covered by the Australian Consumer Law.

Nestful is not required to provide a refund, exchange or credit for change of mind simply because a product was promotional, discounted, on sale or clearance.

If a promotional, clearance, sale or discounted product has a fault, Nestful will provide any remedy required by the Australian Consumer Law.

25. Product Information and Customer Responsibility

Customers are responsible for reviewing product descriptions, specifications, dimensions, compatibility information, product manuals, safety instructions and usage requirements before purchase and use.

Nestful is not responsible for a customer selecting a product that is unsuitable for their intended use where the product was accurately described and the customer did not make that intended use known to Nestful before purchase.

This does not limit any rights the customer may have under the Australian Consumer Law where the product does not match its description, is not of acceptable quality, or is otherwise covered by a consumer guarantee.

26. Privacy and Claim Information

Nestful may collect and use information provided in connection with a warranty, refund, replacement, return, payment dispute or chargeback to assess the claim, process the return, communicate with suppliers, manufacturers, warehouses, carriers, payment providers, insurers, advisers or authorities, and protect Nestful’s legal and commercial interests.

Nestful will handle personal information in accordance with its Privacy Policy and applicable law.
